While Silicon Valley Debates AI Governance, Beijing Has Already Built It

By Sanjeev Sarma

AI Governance Is Not a Future Feature. It’s Part of the Architecture.

We often discuss AI governance as though it begins after a technology becomes powerful enough to worry us. In reality, the most consequential governance choices are made much earlier-in the data pipeline, the model-release process and the systems that determine who is accountable when something goes wrong.

Recent discussion of AI regulation in the United States has revived calls for independent evaluation, stronger oversight and international coordination. But China has already developed layers of rules covering recommendation algorithms, synthetic media and public-facing generative AI, alongside processes for assessment and regulatory filing. The important question is not which country has the perfect model. It is what responsible AI governance must look like when translated into real systems.

Governance belongs in the system design

For enterprise architects, governance cannot be a policy document that sits outside the technology stack. It needs to be designed into the lifecycle of an AI service: from data sourcing and model selection to deployment, monitoring, incident response and retirement.

That means being able to answer practical questions. What data shaped this output? Which model version produced it? What evaluations were conducted before release? Can a risky capability be restricted or switched off? Who investigates if the system causes harm?

These are architectural requirements as much as legal ones. Data lineage, access controls, model registries, audit logs, human escalation paths and rollback mechanisms are not administrative overhead. They are part of building a system that can be trusted in production.

The trade-off is real. More checks can slow experimentation and increase costs, particularly for smaller companies. But skipping them does not remove the cost; it transfers it-to users, customers, public institutions and, eventually, the organisation itself. A model that launches quickly but cannot be inspected, contained or explained can create significant technical and reputational debt.

Principles need operational form

China’s regulatory approach should not be copied wholesale into other jurisdictions. Legal systems, institutions and political priorities differ. Nor should the existence of rules be confused with proof that every risk is controlled.

The broader lesson is that governance needs operational mechanisms. “Be responsible” is not actionable. A risk-based release process is. So are documented evaluations, clear incident ownership, ongoing monitoring and the ability to intervene when a system behaves unexpectedly.

For CTOs and founders, I would start with three questions:

  • What is the system permitted to do-and what must it never do? Define boundaries before deployment, especially when AI can take actions rather than only generate content.
  • Can we demonstrate how the system was assessed? Keep evidence of data provenance, testing, model changes and known limitations.
  • Who has authority to respond? Assign clear responsibility for pausing, restricting or correcting a system when risks emerge.

These controls should be proportionate to impact. An internal assistant that drafts meeting notes does not carry the same risk as an agent interacting with financial, health or public-service systems. Good governance is not one checklist for every use case; it is a disciplined way to match safeguards to consequences.

A practical question for India

For India, this debate has a direct connection to digital public infrastructure and the realities of a diverse, multilingual population. AI systems used in public-facing services must account for more than model accuracy in ideal conditions. They need to be tested across languages, contexts, connectivity constraints and user groups-and designed with clear routes for human review.

This is also an MSME question. If compliance becomes too complex or expensive, smaller innovators may struggle to participate. Shared standards, accessible evaluation tools and clear guidance can help make responsible deployment achievable without turning governance into a privilege reserved for the largest firms.

AI will keep advancing faster than any single rulebook can anticipate. The enduring advantage will belong to organisations that treat accountability, safety and adaptability as design principles-not as paperwork added after launch.
