The Delhi High Court has taken significant action to protect the personality and publicity rights of Sadhguru Jaggi Vasudev, the founder of the Isha Foundation, in response to unauthorized use of his likeness through Artificial Intelligence (AI). In an interim order, the court responded to Mr. Vasudev’s lawsuit aimed at curbing the infringement of his personality rights by various rogue websites and unknown entities.
The court recognized Mr. Vasudev’s distinctiveness, noting that his voice, name, signature, image, and unique style of articulation contribute to a recognizable persona. It emphasized that the objectionable content not only violated Mr. Vasudev’s rights but also involved the misuse of advanced technology to alter his images and videos for commercial purposes.
In a stark warning, the court stated, “If allowed to continue, it will soon spread like a pandemic with wide, uncontrollable repercussions,” particularly on social media platforms. The ruling outlined the potential for the dissemination of misleading information, likening its rapid spread to wildfire.
As part of the order, the court mandated the suspension of accounts and the removal of YouTube channels generating content that violates Mr. Vasudev’s rights, calling for the disclosure of basic subscriber information from these platforms. Furthermore, the court directed the Department of Telecommunications and the Ministry of Electronics and Information Technology to notify social media companies to take necessary actions against these infringing accounts and channels.
The ruling highlighted the vulnerability of public figures like Mr. Vasudev in today’s digital age, where rapid technological innovations can lead to exploitation by rogue websites. The court pointed out the challenges faced by intellectual property rights holders in protecting their unique attributes, especially as these “hydra-headed” websites can reemerge under various guises, making enforcement exceedingly difficult.
“Such websites, under the guise of privacy, mask their registration and contact details, complicating efforts to reach their operators for demands to cease infringing activity,” the court stated in its order, underscoring the importance of adequate legal protections for public figures.
