Republican Senator Mike Lee of Utah has introduced the Interstate Obscenity Definition Act (IODA), a new legislative effort aimed at criminalizing pornography and addressing its perceived harmful effects on American society. Alongside Illinois Representative Mary Miller, Lee advocates for a redefinition of “obscenity” that reflects the challenges of the internet era. The proposed bill stipulates that content qualifies as obscene if it appeals to prurient interests, depicts sexual acts, and lacks literary, artistic, or scientific value.
Specifically, the legislation targets material that “depicts, describes, or represents actual or simulated sexual acts with the objective intent to arouse, titillate, or gratify the sexual desires of a person.” Senator Lee stresses the urgency for updated laws, asserting, “Obscenity isn’t protected by the First Amendment, but hazy and unenforceable legal definitions have allowed extreme pornography to saturate American society and reach countless children.” He further emphasizes that the bill seeks to modernize the legal framework so that harmful content can be promptly removed and its distributors held accountable.
Representative Miller echoed these concerns, asserting that the legislation “equips law enforcement with the tools they need to target and remove obscene material from the internet, which is alarmingly destructive and far outside the bounds of protected free speech under the Constitution.” The IODA aims to halt the creation and distribution of pornographic content, empowering prosecutors to take action. If enacted, the bill would criminalize the transmission of obscene material across state lines, simplifying the prosecution of offenders.
Miller highlights the need to protect American families, stating that she and Lee view their mission as essential for “safeguarding American families and ensuring this dangerous material is kept out of our homes and off our screens.” This initiative aligns with the views of numerous conservative advocates who support censorship regarding pornography, citing its detrimental psychological impacts on young people. Yet, the MAGA movement has faced challenges in distancing itself from controversies related to pornography, including notable incidents such as adult film actress Stormy Daniels’ involvement in President Donald Trump’s “hush money” trial and Senator Ted Cruz mistakenly “liking” explicit posts on social media. House Speaker Mike Johnson has also mentioned that he and his son monitor each other’s devices for exposure to adult content.
