Justice for Kolkata Doctor: Court’s Tough Remarks on RG Kar Medical College Rape-Murder Case – Why CBI Stepped In

The rape and murder of a 31-year-old doctor in Kolkata has ignited nationwide protests, prompting swift legal action. West Bengal Chief Minister Mamata Banerjee initially gave Kolkata Police six days to conclude the investigation. However, the Calcutta High Court preemptively transferred the case to the Central Bureau of Investigation (CBI) due to a lack of progress and potential evidence tampering.

The High Court observed significant lapses by the hospital administration and criticized the former Principal, Dr. Sandip Ghosh, for his handling of the situation. Public interest litigations (PILs) from the victim’s parents and others argued that state police should be replaced by an independent agency to ensure justice and protect evidence.

The parents revealed that their daughter had been in good spirits before her death but were later told she had committed suicide. They were denied immediate access to her body, raising suspicions of a cover-up. The state government countered these claims, highlighting police presence and rapid response at the hospital but acknowledged administrative lapses.

The court reprimanded the Bengal government for quickly reinstating Dr. Ghosh to another principal position. It noted a troubling delay in filing a formal complaint about the death and criticized the hospital for not immediately reporting it as a criminal case.

Acknowledging nationwide protests and the need to restore public confidence, the court mandated that the CBI provide regular updates, beginning with the case’s next hearing in three weeks. The court also appealed to protesting doctors to resume their duties to serve patients, particularly those who rely on public healthcare services.
