A bench of the country’s highest court has issued a cautionary observation about premarital physical relationships, saying young men and women should exercise great care before becoming intimate. Speaking during the hearing of a rape case, Justices B.V. Nagarathna and Ujjwal Bhuyan warned that “to fully trust someone before marriage can sometimes be dangerous,” and advised heightened caution in premarital sexual relations.

Justice Nagarathna acknowledged that the bench’s views might sound old-fashioned to some, but stressed that, before marriage, a young man and woman remain essentially strangers to one another. She said that no matter how deep a relationship feels, couples cannot assume intimacy before marriage without careful thought, and that decisions to trust someone should be made after serious consideration.

The case originated with a young woman’s complaint that she met the accused in 2022 through a matrimonial website. She alleges the man promised to marry her and then engaged in physical relations with her; the two also travelled together for diving. She later discovered the accused was already married and had arranged a second marriage to another woman in Punjab. The complaint also alleges the man recorded their private moments without her consent and threatened to circulate the footage on social media.

During the hearing, the court questioned why the woman would go on a diving trip if marriage was so certain. Government counsel said the couple had been planning to marry, but the bench observed that anyone who holds conservative views about marriage should avoid premarital travel or physical intimacy.

The court emphasized that when relationships are built on mutual consent, criminal prosecution and punishment are not always the sole remedies. The bench urged attention to discussion and mediation as ways to resolve personal and family disputes, underscoring that legal action is only one part of addressing such complex situations.
