The annual cap on H-1B visas remains at 65,000, with an additional 20,000 reserved for candidates holding advanced degrees from U.S. institutions. The new weighted selection process will take effect during the fiscal year 2027 registration season, with the final rule to be implemented on February 27.
The Department of Homeland Security has emphasized that this reform is crucial for aligning the H-1B program with legislative intent and addressing long-held concerns regarding wage suppression and the misuse of the visa category. Officials clarified that while the rule does not exclude access for employers offering lower wages, it does shift emphasis toward applications that reflect higher skill levels and compensation.
