Compassion Prevails: CJI to Reconsider Stray Dog Issue After Petitioner Uncovers 2024 SC Order for Humane Treatment
Chief Justice of India B.R. Gavai has agreed to urgently review a request concerning community dogs, following a contentious August 11 ruling by the Supreme Court. This order mandated the rounding up of stray dogs from Delhi streets and their confinement in shelters within six to eight weeks, banning their return to public spaces.
During a recent hearing, a lawyer highlighted a May 9, 2024, Supreme Court directive advocating for compassion towards stray canines. The lawyer referenced a Supreme Court ruling led by Justice J.K. Maheshwari, which asserted that indiscriminate killings of strays are unacceptable. The court emphasized that authorities must act in accordance with existing legislation, reinforcing the constitutional commitment to treat all living beings with compassion.
The Supreme Court is deliberating on multiple petitions surrounding the conflict between central regulations, such as the Prevention of Cruelty to Animals Act, 1960, and the Animal Birth Control Rules, 2001, against municipal laws. Justice Maheshwari and Justice Sanjay Karol underscored the imperative for humane treatment of all animals, reflecting a broader commitment to animal welfare embedded in the Constitution.
The August 11 decision has sparked outrage among animal rights advocates and organizations, who argue that the proposed plan to house approximately 5,000 community dogs lacks the necessary infrastructure. Critics caution that mass capture could lead to confusion and potential cruelty towards these animals.
Chief Justice Gavai assured that the matter would be addressed while acknowledging the urgent concerns surrounding the issue. The court’s prior ruling, led by Justice Pardiwala, warned that resistance to the rounding up of stray dogs could result in contempt proceedings. Authorities received orders to begin capturing stray canines promptly, particularly in vulnerable areas of Delhi and its outskirts.
The directive arose from a suo motu case addressing heightened incidents of stray dog attacks, particularly on children, leading to heightened public concern. Justice Pardiwala raised a poignant question regarding the potential return of children harmed by aggressive strays, highlighting the gravity of the issue at hand.
With mentions of increasing safety concerns, the court described the situation regarding stray dogs in the national capital and surrounding areas as “extremely grim.” Emphasizing public safety, Justice Pardiwala insisted that the court’s measures were in the public interest and aimed at addressing a growing menace.
