High Court Unleashes Fury on State Government and CBI for Dismal Coordination in Financial Fraud Cases
The Madurai Bench of the Madras High Court has taken a critical stance against both the State government and the Central Bureau of Investigation (CBI) for their inadequate coordination in handling financial fraud cases. The court’s comments came during the deliberation of two petitions filed by the State Bank of India (SBI), which sought judicial intervention to prompt the CBI into action regarding substantial loan frauds amounting to ₹13.11 crore and ₹3.84 crore.
Justice B. Pugalendhi expressed deep concern over the apparent bureaucratic indifference that has stifled any meaningful investigation into these serious allegations. He pointed out that, despite the clear eligibility of these cases for CBI referral under the Reserve Bank of India (RBI) and Ministry of Finance guidelines, the lack of action is not merely due to legal hurdles but reflects a broader failure of both institutions. “What we see here is not just procedural delay but a systemic failure of two public authorities, where indifference and competing interests have undermined the very purpose of justice,” Justice Pugalendhi asserted.
The judge emphasized that the repercussions of such negligence extend beyond isolated incidents, jeopardizing public trust in the justice system. He noted that the petitioner bank, a statutory entity that complied with all procedural directives, was left with no choice but to seek judicial recourse due to the lack of response from both the Centre and the State. “This represents a collapse of institutional responsibility,” he added.
Justice Pugalendhi criticized the agencies responsible for upholding the law, stating that their passive resistance and selective permissions reflect a betrayal of constitutional obligations. “Justice is delayed not because of complexity but due to ego and politics. The court will not stand by as accountability is systematically eroded,” he remarked. In response, the court issued strict directives aimed at streamlining the process for addressing fraud reports.
The judge made it clear that when fraud amounts exceed a threshold, the CBI is not only entitled to act but is also obligated to initiate an inquiry upon receiving complaints from public sector banks, given that state consent is obtained. Once consent is granted, an FIR must be registered without delay, particularly when the complaint discloses a cognizable offence.
Justice Pugalendhi criticized the practice of requiring the CBI to repeatedly submit proposals for consent without substantial justification, describing it as a hindrance that delays investigations and undermines efficiency. “Such bureaucratic practices may even allow offenders to evade legal scrutiny,” he said, advocating for a more consistent approach from the state in processing consent requests.
In his ruling, the judge directed the Chief Secretary and the Zonal Head of the CBI to assess procedural delays and implement accountability measures. He reminded both the State and the CBI that their allegiance should lie with the Constitution and the rule of law, rather than with political convenience or comfort. The court has now instructed the CBI to proceed with the complaints filed by SBI, aiming to restore public confidence in the justice system.
