Amid the ongoing legal dispute concerning the Special Revision of the Electoral Roll (SVR) process in Bihar, the Supreme Court has drawn attention to a significant 1977 ruling regarding the powers of the Election Commission. Opposing parties allege that this process could undermine the voting rights of many marginalized people in Bihar.
A bench led by Chief Justice Sudhanshu Dhulia referenced previous judgments during the hearing, emphasizing that the Election Commission must operate with a focus on justice and public interest. He reminded all stakeholders that free and fair elections are the cornerstone of democracy, and the rights of any voter group, regardless of size, must not be unjustly compromised.
The Supreme Court clarified that while the Election Commission possesses extensive authority over election management, it must deploy this power equitably and transparently. The 1977 ruling highlighted that the Commission has significant powers, but these should not be exercised capriciously or without just cause. Should the Commission misuse its authority, the court has the right to intervene to rectify the situation.
The 1977 case initially arose when the Election Commission canceled an election due to violence, allowing for a fresh election to be held afterward. A candidate challenged this decision, asserting it adversely affected his chances of victory. While the court upheld the Commission’s authority, it underscored that such powers should not lead to unfairness or abuse during elections.
In simpler terms, the Supreme Court has reiterated that although the Election Commission is empowered to manage elections effectively, mechanisms must be in place to prevent the misuse of that power. The judiciary is prepared to act if necessary to restore order. It is noteworthy that the next hearing in this case is scheduled for July 10.
