Crackdown on Corruption: Accountability Amplified for Officers Ignoring Illegal Construction

In a decisive bid to tackle unauthorized construction, Karnataka has enacted the Karnataka Planning Authority (Levy of Penalty on Jurisdictional Officer for Failure to Prevent Unauthorised Development) Rules, 2021. Effective from April 8, 2025, this mandate introduces stringent accountability measures for jurisdictional officers who fail to prevent unlawful developments and deviations from sanctioned building plans.

According to the notification, penalties will be imposed by a designated authority, ensuring the culpability is assigned based on jurisdiction. Before any sanctions are applied, the involved officers are entitled to a fair hearing, reinforcing due process. Funds collected through these fines will be directed to a government account, earmarked exclusively for developmental projects.

The framework distinctly classifies officers responsible within various urban and rural planning entities, including the Bangalore Development Authority (BDA), Bruhat Bengaluru Mahanagara Palike (BBMP), Urban Development Authorities, and Gram Panchayats. Notably, even high-ranking officials such as the BDA and BBMP Commissioners are subject to these fines, highlighting a comprehensive approach to accountability.

Under this new regulation, officers exhibiting negligence will face significant penalties. A first-time offense incurs a ₹50,000 fine, doubling to ₹1,00,000 for a second offense. For any subsequent violations, reports will be submitted to the State government for potential disciplinary action as stipulated under the Karnataka Civil Services Rules. This escalating penalty system underscores the seriousness with which the State intends to enforce compliance.

However, procedural fairness is embedded in this regulation as officers may appeal the penalties within 45 days. These appeals will be meticulously reviewed by higher authorities within a 90-day timeframe, ensuring a balanced and just examination process.

This initiative signals Karnataka’s firm stance on curbing illegal constructions, setting a precedent for transparency and strict adherence to urban planning norms. By maintaining meticulous control over developments, the State aims to enhance infrastructure integrity and promote orderly urbanization.

The rules emerge in response to growing concerns over rampant unauthorized constructions that have often posed significant safety and planning challenges. By holding officials directly accountable, Karnataka addresses these issues head-on, aiming for a deterrent effect that discourages negligence and promotes vigilant compliance with building regulations.
