High Court Directs Release of Details on Pending Cases Involving MPs and MLAs

The Guwahati High Court has taken a step towards transparency, ordering authorities to provide specific information on the reasons behind the prolonged delay in cases involving Members of Parliament (MPs) and Members of Legislative Assembly (MLAs). The move stems from a suo motu writ petition filed to inquire into the status of pending cases involving these public figures.

The Court’s directive follows a report submitted by the registry on March 10, 2025, which revealed that seven out of 15 cases pending at the Principal Seat of the Gauhati High Court have been disposed of, with eight others at an advanced stage of hearing. The report also highlighted that significant progress has been made in the disposal of cases involving MPs and MLAs.

However, the Court noted that the picture is quite different in the district judiciary in Assam, with cases pending for over a decade, often stuck at the stage of accused persons’ appearance. "It is not clear why these cases are pending for so long merely for ‘appearance’," the Court observed. If the accused’s appearance could not be secured due to reasons such as the complainant’s failure to issue process, it is unclear why consequential orders were not passed.

The Court has directed the registry to obtain relevant information from concerned authorities, including reasons for the delays, and relevant orders passed by the concerned court, to deal with the situation. The move is seen as an effort to increase transparency and accountability in the judicial process.

The Court’s move has sparked hope that the sitting politicians may soon face consequences for their alleged wrongdoings, bringing relief to the public. The development is a significant step towards ensuring accountability in the system, and it remains to be seen how the authorities respond to the courts’ demands.
