ED Strikes with Hefty Rs 3.44 Crore Penalty on BBC India for FEMA Violations: A Shocking Turn of Events
Two years after initiating a case against BBC India under the Foreign Exchange Management Act (FEMA) for alleged violations, the Enforcement Directorate (ED) has issued an adjudication order imposing a penalty of Rs 3.44 crore on the broadcaster. In addition, three directors—Giles Antony Hunt, Indu Shekhar Sinha, and Paul Michael Gibbons—have each been fined Rs 1.14 crore for their roles in overseeing operations during the contravention period. The ED’s action stems from an Income Tax Department investigation in February 2023, which revealed alleged “non-compliance” with transfer pricing rules and profit diversion.
The penalties include not only a major financial levy on BBC World Service India but also a daily fine of Rs 5,000 from October 15, 2021, until compliance. The discrepancies surfaced after a BBC documentary titled “India: The Modi Question” on the 2002 Gujarat riots was released, prompting the Indian government to seek its removal from YouTube and Twitter. It claimed the content undermined India’s sovereignty and integrity.
According to an ED official, the case’s crux is the violation of a government-imposed 26% FDI cap for digital media, with BBC WS India maintaining 100% FDI, in direct defiance of regulations set forth by a DPIIT press note on September 18, 2019. This led to a showcause notice issued in August 2023 to the broadcasters and involved personnel.
A BBC spokesperson responded, stating that neither BBC World Service India nor its directors have yet received the order from the ED. They affirmed the company’s commitment to adhering to all local laws and will consider appropriate actions once the order is reviewed.
The incident underscores the ongoing scrutiny of foreign media operations in India and highlights the complex landscape of international regulatory compliance.
