Shocking Ruling: Italy’s Court Halts Migrant Detentions in Albania, Derailing Meloni’s Bold Plan
A Rome court has ordered the transfer of 43 migrants, originally from Egypt and Bangladesh and detained in Albanian camps, to Italy, according to a Reuters report. This decision challenges Prime Minister Giorgia Meloni’s strategy to limit irregular sea arrivals by housing migrants in Albania while processing their asylum applications. Since its inception last October, this is the third instance where judges have instructed the relocation of migrants to Italy. The right-wing Italian government had established two facilities in Albania specifically for this purpose, but the plan has faced consistent legal obstacles.
The ruling was quickly embraced by opposition parties, with Nicola Fratoianni of the Green-Left Alliance criticizing the deportation strategy, calling it futile. The Italian Interior Ministry has refrained from commenting.
According to sources, the court has referred the matter to the European Court of Justice (ECJ) for further examination. Meanwhile, the 43 migrants are set to be transferred to Italy on Saturday. This development follows a previous court decision, which questioned the compliance of Italy’s migrant detention scheme with an ECJ ruling. The ECJ mandate specified that no country of origin could be deemed entirely “safe” if any part of its territory posed danger, thereby complicating Italy’s plan to fast-track repatriations.
This ongoing legal dispute highlights tensions between Meloni’s government and the judiciary, with officials accusing courts of politically motivated interference. The ECJ is expected to review Italy’s approach soon to determine its alignment with EU legislation.
