World Bank Neutral Expert Triumphantly Supports India in Indus Water Treaty Dispute with Pakistan
The ongoing dispute between India and Pakistan over the Kishenganga and Ratle hydroelectric projects in Jammu and Kashmir has reached a significant decision point under the framework of the Indus Water Treaty. A Neutral Expert, appointed by the World Bank, has declared itself competent to adjudicate the differences between the two countries, specifically concerning the design aspects of the contested projects. This announcement follows India’s request for expert evaluation and rejection of Pakistan’s plea to convene a Court of Arbitration.
The Indus Water Treaty, an agreement established in 1960, regulates water distribution and management between the two nations, with provisions to address disputes. This latest decision underscores the treaty’s mechanisms for peaceful resolution, emphasizing the role of the Neutral Expert. The Ministry of External Affairs (MEA) of India has reiterated its stance that the expert alone is equipped to resolve issues related to the hydroelectric projects in question.
The MEA expressed satisfaction, highlighting that all seven questions concerning these hydro projects have been submitted for the Neutral Expert’s consideration. The appointment of both a Neutral Expert and a chairman of the Court of Arbitration by the World Bank in 2022 aimed to address growing tensions and unresolved questions surrounding the hydroelectric projects. However, with the Neutral Expert’s recent declaration, it appears that arbitration may no longer be necessary unless further escalations occur.
