Fierce Showdown: Airtel, Reliance Jio, and Vodafone-Idea vs. WhatsApp, Google & OTT Giants Ignite Epic Battle!
The Telecom Regulatory Authority of India (TRAI) finds itself in a challenging position amidst escalating tensions between telecom operators and tech companies over the regulation of Over-the-Top (OTT) platforms. Telecom companies, including giants like Airtel, Reliance Jio, and Vodafone-Idea, are urging for stringent regulatory measures on OTT platforms, such as WhatsApp and Google, which they argue contribute significantly to spam and online scams but elude accountability due to current regulatory frameworks. They insist on incorporating OTT platforms into the Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018, which are being reviewed.
However, the Broadband India Forum (BIF), representing tech companies, argues against this, stating that OTT platforms are already governed by the Information Technology Act, and any further oversight by TRAI is redundant. BIF’s senior deputy director-general, Debashish Bhattacharya, criticized telcos’ demands as legally unwarranted and stressed that TCCCPR is designed for telecom service providers, not OTT platforms.
The issue centers on who should bear responsibility for unsolicited commercial communications (UCC). Telecom operators argue they unfairly shouldered penalties associated with spam, despite serving merely as intermediaries. They propose that telemarketers and business entities sharing responsibly and financially for spam, ensuring greater accountability and transparency in the message delivery chain. Vodafone Idea’s Ambika Khurana and Reliance Jio’s UK Srivastava emphasized the need to distribute the burden of financial penalties more evenly. Rahul Vatts of Bharti Airtel pointed out the inconsistency in regulation between platforms sending spam messages.
As TRAI Chairman AK Lahoti deliberates on the new regulations, he assures that all viewpoints will be taken into consideration to strike a balance that addresses the concerns of both the telecom and tech industries. The outcome will likely shape the future landscape of digital communications in India.
