Rajya Sabha’s Landmark Approval: Oilfields Act Amendments Celebrated by Union Minister Puri

The Rajya Sabha, on Tuesday, approved significant amendments to the Oilfields (Regulation and Development) Act of 1948, aiming to facilitate business operations and accelerate the expansion of India’s energy sector. Petroleum and Natural Gas Minister Hardeep Singh Puri praised the amendments as “a historic step into the future,” emphasizing their role in bolstering India’s energy sector under Prime Minister Narendra Modi’s leadership. These changes aim to ensure policy stability, international arbitration, and extended lease periods.

A key aspect of the amendments is the elimination of ambiguous terms like “mine,” “quarried,” or “excavated” from the current act. This is expected to enhance the ease of doing business in a sector increasingly driven by technology. The term “mineral oil,” traditionally associated with natural gas and petroleum, will be updated to accommodate modern understandings as unconventional hydrocarbon resources evolve.

The revisions redefine mining leases, clarifying that pre-existing leases will retain their status but will cease using the outdated terminology. Instead, the term “petroleum lease” will become standard, promoting investor confidence and encouraging the implementation of Enhanced Recovery methods and effective reservoir management practices.

Furthermore, the amendments empower the government to establish rules fostering environmental protection, promote green energy projects, and facilitate energy transition measures. These initiatives are designed to support India’s climate objectives, enabling both the government and energy companies to pursue their sustainability goals.

Minister Puri also highlighted provisions to support small operators and new market entrants, who often encounter high infrastructure costs. The new rules will facilitate the sharing of production and processing facilities among multiple lessees. Additionally, a structured mechanism for imposing penalties and handling appeals has been introduced, with the establishment of an adjudication authority. These changes aim to streamline operations and enhance regulatory clarity in India’s burgeoning energy sector.
