Supreme Court Shockingly Rejects Biden’s Crucial Rule Protecting Trans Students from Discrimination
The divided US Supreme Court has chosen not to enhance the Biden administration’s efforts to broaden anti-discrimination protections for transgender students nationwide. This decision upholds two lower court rulings that temporarily block a new Education Department rule in 10 states, which was set to take effect on August 1 in certain areas. The core issue is a contentious legal battle focusing on provisions that would allow students to use facilities aligning with their gender identity and mandate teachers to use students’ preferred pronouns, potentially leading to penalties for non-compliance.
In a mixed response, Justices Sonia Sotomayor, Elena Kagan, Ketanji Brown Jackson, and Neil Gorsuch partly dissented, advocating for the rule’s implementation in the 10 states involved, according to Bloomberg. However, the Biden administration, through Solicitor General Elizabeth Prelogar, did not seek Supreme Court approval for these contested provisions. Instead, Prelogar requested reinstatement of less controversial elements of the rule while legal proceedings continue.
Prelogar contended that federal judges in Kentucky and Louisiana issued overly broad injunctions, blocking the entire rule. The administration aims to reinstate parts of the rule that recognize gender identity under current anti-discrimination laws and enhance protections for pregnant and postpartum students.
The states in opposition argue that the rule’s provisions are interconnected, posing significant compliance costs and causing confusion as the academic year commences. Louisiana and three other states asserted that even partial implementation would require substantial time and resources, per Bloomberg’s reports.
The lawsuits involve Tennessee, Kentucky, Indiana, Ohio, Virginia, West Virginia, Louisiana, Mississippi, Montana, and Idaho. To date, roughly 20 states have legally contested the rule, with other challenges pending in lower courts. Nevertheless, the rule is fully effective in regions not affected by these rulings.
