Gauhati High Court Issues Notice to Assam Legislative Assembly Speaker Over MLA’s Suspension
The Gauhati High Court has issued a notice to the Speaker of the Assam Legislative Assembly concerning the suspension and disqualification of Sherman Ali Ahmed, a suspended Congress MLA. This order, passed on September 9, 2024, comes in response to a petition filed by senior Congress leader Rakibul Hussain.
Hussain initially filed the petition on May 2, 2024, seeking Ahmed’s disqualification under the Tenth Schedule of the Indian Constitution. The disqualification plea was based on grounds of defalcation related to the schedule, following Ahmed’s suspension by the Congress party.
The Supreme Court, in Civil Appeal No.547/2020, mandated on January 21, 2020, that a Speaker must decide such disqualification petitions within three months from the date of filing. Despite this, the Speaker of the Assam Legislative Assembly had taken no action, prompting Hussain to approach the Gauhati High Court by filing WP (C) No.4586/2024.
In its latest order, the High Court has directed the Speaker, Principal Secretary, Secretary of the Assam Legislative Assembly, and Sherman Ali Ahmed to submit their affidavits by September 27, 2024, the date of the next hearing. The court emphasized that ongoing legal proceedings should not impede the Speaker’s duty to resolve the disqualification petition.
This development adds another layer to the ongoing political controversy surrounding Sherman Ali Ahmed and highlights the judicial oversight in legislative matters. The case underscores the importance of timely judicial and legislative processes in maintaining democratic accountability and upholding the rule of law.
