The U.S. government reversed its earlier decision to impose sanctions on Brazilian Supreme Court Justice Alexandre de Moraes on Friday. The sanctions, which also included his wife and her overseen Lex Institute, were initially enacted due to de Moraes’ role in the trial of former Brazilian President Jair Bolsonaro. The change was documented by the Treasury’s Office of Foreign Assets Control, which manages U.S. sanctions programs.
The Brazilian government welcomed this development, which followed a recent phone call between U.S. President Donald Trump and Brazilian President Luiz Inácio Lula da Silva, as reported by Bloomberg. The original sanctions, imposed in July, accused de Moraes of abusing his authority to instigate arbitrary pretrial detentions and limit freedom of expression in Brazil.
A senior official from the Trump administration indicated that the sanctions were lifted following Brazil’s lower house passing an important amnesty bill, a sign perceived as an improvement in the “lawfare” climate within the country. This decision appears to mark a thaw in the previously tense relationship between the two governments. Trump’s administration had viewed Lula’s predecessor, Jair Bolsonaro, as a key ally during his term, with the former leader even being dubbed the “Trump of the Tropics.”
The accusations against Bolsonaro were severe. He was alleged to have orchestrated a plan to maintain his position despite losing the 2022 election to Lula. Trump himself faced similar allegations in 2021 when a mob of his supporters stormed the Capitol in an effort to overturn the election results. Bolsonaro was ultimately convicted and sentenced to over 27 years in prison, beginning his sentence last month while seeking house arrest due to health concerns. However, the expected political shift following his imprisonment did not materialize, even as he continues to wield considerable influence with elections approaching next year.
Despite the lifting of sanctions, the current Brazilian government expressed discontent with the decision. Gleisi Hoffmann, Brazil’s minister for institutional relations, labeled it a significant defeat for Bolsonaro and his family. Hoffmann claimed that it was Lula who brought the repeal of sanctions to Trump’s attention through a “dignifying and sovereign dialogue.”
Eduardo Bolsonaro, a lawmaker and son of the former president, expressed regret at the news of the sanctions being lifted. He had previously announced plans to relocate to the U.S. to lobby the Trump administration to aid his father’s legal situation. Upon the initial sanctions, the U.S. acted under the Global Magnitsky Human Rights Accountability Act-a law targeting human rights violators and corrupt officials-aimed at addressing serious violations of human rights.
