Delhi Court Rejects Anticipatory Bail for Luthra Brothers in Goa Fire Case
Senior advocate Tanvir Ahmed Mir, representing the Luthra brothers, recently presented several arguments in court concerning an incident they are involved in, as reported by ANI. Central to his defense was the assertion that the event in question was due to negligence rather than an intentional act. Mir stated, “As per the FIR, the incident occurred due to negligence, and it is not homicidal.”
The counsel emphasized the hostile environment faced by the accused, citing threats against their family and the swift demolition of their properties. He remarked, “There were people all around social media, and there was a threat to the applicant’s family.” He also noted that two of their restaurants were bulldozed without any prior notice.
Advocate Mir expressed the Luthras’ willingness to cooperate with authorities while underscoring their right to be presumed innocent and to have their legal safeguards respected. He argued that standard investigative procedures were not followed when a warrant was issued immediately and pointed out that the absence of the accused was due to managerial responsibilities and a prior commitment. “No notice to join the investigation was given. A warrant was issued straight away. My (Luthras) managers manage 40 restaurants all over India; the men sitting in Delhi cannot be present everywhere,” he explained.
He further clarified that the Luthras had previously booked a ticket for an event in Phuket, which accounted for their absence.
