NGT Rejects Petition Against West Point Mall: A Step Forward in Retail Development
Gangtok, the Capital City of Sikkim, has seen a significant development in its infrastructure with the construction of the 14-story West Point Mall. This project has been the subject of controversy, with environmental and regulatory concerns being raised by Dr. Bina Basnet (Shanti) in a long-standing case. The National Green Tribunal (NGT) at the Kolkata Court has now dismissed the case, bringing an end to the years-long dispute.
The NGT’s double bench, comprising Justice B Amit Sthalekar, Judicial Member, and Dr. Arun Kumar Verma, expert member of NGT, Kolkata Court, pronounced their judgment in an online decision. According to the judgment, the project meets the necessary guidelines and complies with engineering standards, as also affirmed by IIT-Roorkee’s recent vetting.
Dr. Basnet had originally challenged the State government’s approval of the project, citing potential adverse impacts on the local environment. However, the NGT, after thorough review, has ruled that the project poses no significant environmental or regulatory concerns.
In their judgment, the NGT panel stated, “Upon a consideration of the facts of the case and the submissions of the learned Counsel for the parties, we find no merit in the present original Application and the same is accordingly dismissed.” This decision brings an end to the long-standing case, with the government now free to proceed with the construction of the mall.
The West Point Mall project has been a topic of controversy in Sikkim, with concerns raised about its impact on the environment. The NGT’s decision is likely to be seen as a significant development in the region, with the government now being able to focus on other infrastructure projects.
In conclusion, the NGT’s decision to dismiss the case against the West Point Mall project is a significant step forward for the government and the people of Sikkim. The project, which has been the subject of controversy, is now clear to proceed, pending any further regulatory or environmental concerns. The case serves as a reminder of the importance of balancing development with environmental protection, and it is hoped that this decision will set a positive precedent for future projects in the region.
