Empowering Justice: Punjab and Haryana HC Declare Right to Know Medical Status a Fundamental Right

In a recent ruling, the Punjab and Haryana High Court expressed shock over the illegible handwritten medical prescriptions and notes by government doctors, which are often unreadable by anyone other than certain doctors and chemists. Justice Jasgurpreet Singh Puri, reviewing a medico-legal report related to an anticipatory bail plea in a rape case, highlighted the issue and pointed out that, in today’s digital age, it’s surprising that such critical documents are still handwritten.

Justice Puri emphasized that understanding medical prescriptions and histories is a fundamental right under Article 21 of the Indian Constitution, as it pertains to the right to life and health. This right extends to patients and their attendants to be able to examine the medical advice and treatments provided to them clearly.

The court called upon the Advocate Generals of Haryana and Punjab, as well as the Senior Standing Counsel of Chandigarh, to propose remedial solutions for unclear medical handwriting in both government and private practices. The high court also sought assistance from the National Medical Commission (NMC) and appointed Advocate Tanu Bedi as Amicus Curiae to assist in this matter.

Justice Puri urged that significant corrections are necessary to address this widespread issue across Punjab and Chandigarh. The case has been adjourned for a further hearing scheduled for February 13, signaling the court’s commitment to finding a resolution to improve the clarity and accessibility of medical documentation, ensuring that patients’ rights are prioritized and upheld.
