Kerala High Court Denial of Abortion for Minor Rape Survivor Sparks Outrage
The Kerala High Court has rejected a plea from a father in Thrissur seeking to terminate his 16-year-old daughter’s pregnancy, which resulted from rape. The judgment, delivered on October 30, addressed the petition after the pregnancy was discovered during a medical examination, at which point the gestation period had surpassed 25 weeks. Under the Medical Termination of Pregnancy Act, termination beyond 24 weeks is generally prohibited unless there is a diagnosis of substantial fetal anomaly. In this case, the medical report indicated no such anomalies, nor did it suggest that the survivor’s mental health was at grave risk. Consequently, the court concluded that the request for termination could not be granted.
