Nagaland Government Seeks SC Sanction to Prosecute Army Personnel in Oting Killing Case

In a significant development, the Nagaland government has approached the Supreme Court seeking permission to prosecute 30 Army personnel accused of killing 13 civilians in the December 2021 Oting incident. This move comes after the Centre denied the necessary sanction to initiate legal proceedings against the security forces involved in the botched operation.
Nagaland Minister and senior BJP leader Temjen Imna Along emphasized the state’s commitment to ensuring justice for the victims. Speaking to Northeast Live, Along stated that the Oting incident constituted a severe human rights violation. He added that as protectors of the people’s interests, the state government decided to escalate the matter to the Supreme Court.
The plea challenges the Centre’s refusal to authorize prosecution, which is required under the Armed Forces Special Powers Act (AFSPA) before any legal action can be taken against security personnel operating in designated areas.
