BSF Convicted: 42-Year Sentence for Mizoram Gang-Rape, Acid Attack
Aizawl: A court here on Tuesday sentenced two Border Security Force (BSF) personnel to a combined 42 years’ rigorous imprisonment and fined each Rs 60,000 for gang-raping a woman and throwing acid on her face in 2017. The sentences — 20 years, 10 years and 12 years on separate charges — were ordered to run concurrently, meaning the convicts will serve the longest term of 20 years minus the period of detention already undergone during investigation and trial.
Aizawl Additional District and Sessions Judge Sylvie Z Ralte convicted the accused, identified as Nilanjan Das and Dinesh Kumar, under Indian Penal Code sections 376D (gang rape), 376(2)(m) (rape causing grievous bodily harm) and 326A (acid attack) read with Section 34 (common intention).
“For the offence under IPC Sec 376D (gang rape), the accused are sentenced to undergo rigorous imprisonment for a period of 20 years and to pay a fine of Rs 20,000 each. In default of payment of fine, they shall undergo further simple imprisonment for two months,” Judge Ralte said. The court also sentenced both men to an additional 10 years and a fine of Rs 20,000 each under Section 376(2)(m).
On the acid attack charge under IPC Sec 326A, the judge ruled: “The accused persons are sentenced to undergo rigorous imprisonment for 12 years and to pay a fine of Rs 20,000 each.” The combined fines — Rs 60,000 per accused — were ordered, if realised, to be paid to the victim to cover medical treatment and rehabilitation.
The court directed that the substantive sentences run concurrently. The judgment follows the 2017 incident in which the woman was allegedly gang-raped and had acid thrown on her face; the verdict and penalties reflect convictions on multiple serious criminal counts laid against the two BSF personnel.
