Umar Khalid, a former Jawaharlal Nehru University student leader accused in the conspiracy case linked to the February 2020 northeast Delhi violence, has filed a review petition in the Supreme Court challenging the court’s recent order that refused him bail. In the petition, Khalid asks the court to reconsider its decision and also requests that his case be heard in open court as a fast-track matter rather than being examined only in a judge’s chamber.
Khalid’s legal team argues the earlier refusal overlooked several important legal points. The petition contends that the legal tests and conditions applied to grant bail under the Unlawful Activities (Prevention) Act (UAPA) were improperly imposed in his case. His lawyers further say there is no direct evidence showing Khalid’s personal involvement in violent acts, and that keeping him in custody for a prolonged period infringes on his fundamental rights.
Although review petitions are typically examined in a judge’s chamber, Khalid has insisted on an open-court hearing, stating that the case raises critical questions about democratic rights and freedom of speech that should be argued in public. The Delhi Police arrested Khalid in connection with allegations of a wider conspiracy behind the February 2020 violence; he has remained in judicial custody since.
The Supreme Court has not yet decided whether to admit the review petition. The court’s next procedural rulings will determine whether the petition will be placed for an open hearing and whether Khalid’s path to bail will be reopened or he will continue in custody.
