The Bombay High Court has directed a local magistrate’s court to expedite the trial of two narcotics cases involving a Yemeni national, highlighting concerns over the strain his prolonged stay in India is placing on public resources. The court’s ruling came during a hearing on December 23, when a petition was filed by Galal Naji Mohammed, who requested directions for visa processing after his original visa expired.
Entering India legally with the necessary documentation, Mohammed was arrested last year by the Narcotics Control Bureau (NCB) for alleged violations of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The charges against him involve several sections of the Act, and the associated complaints are currently pending in the Metropolitan Magistrate, 8th Court, Esplanade, Mumbai, awaiting summary trials.
The Division Bench, comprising Justices A.S. Gadkari and R.R. Bhonsale, noted that Mohammed cannot be deported to Yemen while his cases remain unresolved, thereby necessitating his continued stay in India. The judges remarked that this situation imposes an unnecessary burden on the government’s resources, as he relies on state provisions for basic necessities during this period.
During the proceedings, Advocate Aruna Pai, representing the Union government, referenced a Standard Operating Procedure (SOP) issued by the Ministry of Home Affairs on December 10. This SOP mandates that the FRRO must process any visa extension application from Mohammed within three weeks. In response to this assurance, the Bench instructed Mohammed to submit his visa application within a week.
Emphasizing the urgency of resolving the NDPS cases, the court directed the magistrate to conclude the trials within three months from the order date. “The direction is issued considering the petitioner’s foreign national status and the summary trial provisions,” the judges explained. Additionally, they urged the NCB to collaborate with the trial court to facilitate a swift resolution.
The petition was subsequently disposed of with all parties instructed to act on an authenticated copy of the order. This ruling underscores the judiciary’s commitment to ensuring that legal processes are conducted efficiently, particularly in cases involving foreign nationals.
In a landscape where judicial efficiency and resource management are paramount, this case illustrates the balance courts must strike between legal obligations and the practical implications of foreign detainees awaiting trial.
