Advocate Pradip Konwar, representing the Assam government in the Zubeen Garg case, announced on October 15 that all five accused were presented in court after completing 14 days of judicial custody. The court ordered that they be remanded back to judicial custody, effectively meaning they will remain in jail.

Following the hearing, Konwar confirmed to reporters that none of the five accused had filed bail petitions. He explained that the investigating agency did not request further custody as the law prohibits extending custody beyond 14 days. “There is no provision to extend custody beyond 14 days. That is the bar,” he stated.

Addressing concerns raised in court regarding the safety of the accused during their imprisonment, Konwar noted that the court instructed jail authorities to ensure their full security. “The court has given directions for their safety. It is the duty of the jail authority to ensure that. They are under full security,” he emphasized.

He further clarified that no special instructions for additional facilities for the accused were provided, and their treatment adheres to standard jail protocols. “As per the jail manual, they are receiving all facilities,” Konwar added.

In connection with a separate case against one of the accused, Shyamkanu Mahanta, reported to involve the Enforcement Directorate (ED), Konwar mentioned that the ED has yet to file for custody in this matter. “ED has not moved any application for custody so far,” he informed.

When questioned about the potential for transferring the accused to another state for security reasons, Konwar indicated that such decisions are at the discretion of the investigating officer. “If the CID or SIT feels security concerns, they may apply to the Honourable Court for transferring the accused to another prison. The court will then make a decision,” he explained.
