Lawyers representing Luigi Mangione filed a motion in federal court on Saturday seeking to dismiss several criminal charges against him, including the only count that carries the potential for the death penalty. This request centers around a federal indictment stemming from the December assassination of Brian Thompson, the chief executive of UnitedHealthcare. The 27-year-old Mangione has garnered international attention since the manhunt that followed the fatal shooting, during which he pleaded not guilty to both state and federal charges.

In documents submitted to a Manhattan federal court, Mangione’s legal team argued that prosecutors should be prohibited from using statements he made to law enforcement, as well as evidence found in his backpack, which contained a gun and ammunition. The defense maintains that Mangione was not read his rights prior to police questioning and that law enforcement conducted an unlawful search of his backpack without obtaining a warrant.

This latest filing follows a previous motion from last month, where Mangione’s attorneys requested the dismissal of federal charges and urged that the death penalty be removed from consideration. Their argument was bolstered by comments from U.S. Attorney General Pam Bondi, who publicly called the killing a “premeditated, cold-blooded assassination that shocked America.” In April, Bondi instructed New York prosecutors to pursue the death penalty in this case, intensifying the focus on Mangione’s alleged actions.

Mangione’s potential death penalty charge arises from a federal statute governing murders committed with firearms as part of “crimes of violence.” Notably, such federal charges are rare in New York, where murder cases are typically adjudicated in state courts. The defense argues that the prosecution has failed to establish the necessary framework to convict Mangione under this statute, claiming that the other alleged crime, stalking, does not qualify as a crime of violence as defined by federal law.

Following the killing of Thompson, a manhunt was swiftly launched. Authorities determined that the suspect fled the scene on a bicycle, traveling to Central Park before taking a taxi to an interstate bus depot. Mangione was ultimately apprehended five days later, based on a tip from a McDonald’s located 233 miles away in Altoona, Pennsylvania. Since his arrest, he has been held without bail.

As the case unfolds, all eyes remain on the courtroom, where the legal complexities may shape the future of both Mangione and the broader discourse surrounding capital punishment in the U.S. legal system. The evolving narrative continues to draw significant public interest, reflecting ongoing debates about the implications of violent crime and justice in America.
