Bombay HC’s Insight: Wives Resorting to Police Complaints for Family Lessons
The Nagpur bench of the Bombay High Court has raised concerns about the abuse of Section 498A of the Indian Penal Code, highlighting a trend where women are increasingly implicating all members of their husband’s family in criminal cases stemming from marital disputes. In a recent ruling, the court dismissed a First Information Report (FIR) against seven family members but did not extend the same relief to the husband.
According to a report by LiveLaw, a division bench led by Justices Anil Kilor and Pravin Patil noted that there is a growing tendency for wives, in cases of marital discord, to involve their husbands and in-laws in allegations of wrongdoing. The judges remarked that police complaints sometimes serve as a tool to “teach a lesson” to the husband’s family, often based on broad allegations lacking specific evidence.
The bench was considering a petition from a man and his family members who sought to quash an FIR lodged against them under Sections 498A, 323, 504, and 506 of the IPC, as well as provisions from the Dowry Prohibition Act. The complaint, filed on August 30, 2023, claimed that the wife had endured mental and physical cruelty, including derogatory remarks and harassment related to dowry, following their marriage on June 2, 2014.
The husband’s family contended that the allegations were baseless and driven by personal vendettas. They pointed out that the complainant had left their home on June 29, 2022, leading to a missing person’s investigation by the police. Furthermore, a divorce petition submitted by the husband is currently pending in a family court in Buldhana.
While acknowledging the serious marital discord between the couple, the court refused to quash the FIR against the husband. However, it determined that the claims against the in-laws were vague and lacked specific details regarding time and place, which led to the quashing of the FIR against them.
