Victory for Workers: Judge Blocks Trump Administration’s Devastating Mass Layoffs at U.S. Agencies

This much is undisputed. But Congress creates federal agencies, funds them, and gives them duties that-by statute-they must carry out.” She noted that agencies are bound by congressional regulations and cannot conduct extensive reorganizations or cutbacks without collaborating with Congress.
The injunction arose from a lawsuit filed by numerous labor unions representing federal workers alongside advocacy groups and several municipalities dissatisfied with the administration’s implementation of its February 11 executive order. That order announced a “critical transformation of the Federal bureaucracy,” directing agency heads to brace for significant workforce reductions.
In response to Illston’s obstruction of their reorganization efforts, the Trump administration appealed to the 9th U.S. Circuit Court of Appeals on Friday morning in attempts to lift the injunction before it takes effect. U.S. Solicitor General John Sauer argued that the far-reaching injunction not only restricts the Executive Branch from making necessary adjustments to the federal workforce but also requires the disclosure of sensitive departmental documents typically protected under executive privilege. Sauer asserted, “Neither Congress nor the Executive Branch has ever intended to make federal bureaucrats a class with lifetime employment, whether there was work for them to do or not.”
