
NHRC Investigates Alleged Rights Violation in Professor Mahmudabad’s Arrest
The National Human Rights Commission (NHRC) has initiated suo motu cognizance of media reports regarding the arrest of Ashoka University Professor Ali Khan Mahmudabad in Haryana. The NHRC’s press release indicates that the allegations against Mahmudabad appear to violate his human rights and personal liberty.
According to reports from LIVELaw, the NHRC has formally notified Haryana’s Director General of Police, demanding a detailed report on the situation within one week. This action follows the Supreme Court’s decision earlier today to grant interim bail to Mahmudabad related to a police FIR concerning his social media posts on ‘Operation Sindoor.’
Mahmudabad was arrested on May 18 and has remained in custody since then. While granting bail, the Supreme Court allowed the investigation to proceed without any stay orders. Furthermore, the court has instructed the Haryana DGP to form a Special Investigation Team (SIT) within 24 hours to clarify the context of the social media posts.
As a condition of his interim bail, the court has prohibited Mahmudabad from posting or commenting on any matters pertaining to his social media activity or expressing opinions on terrorism or India’s responses. The court has also mandated his full cooperation with the investigation and ordered him to surrender his passport.
Yesterday, a local court in Sonepat denied the State Police’s request for a 7-day custody extension, instead sending Mahmudabad to judicial custody. Initially, on May 18, the professor was placed in police custody for two days by a Magistrate.
Mahmudabad faces charges under various sections of the Bharatiya Nyaya Sanhita, which include offenses that threaten communal harmony, make assertions likely to disturb peace, endanger national sovereignty, and insult a woman’s modesty.
