Justice Elena Kagan raised pointed questions on May 15 during a Supreme Court hearing regarding the Trump administration’s efforts to limit nationwide injunctions issued by federal judges. These injunctions are pivotal in a high-stakes case centered on birthright citizenship. Kagan emphasized the practical implications of eliminating universal injunctions, questioning how the Supreme Court would handle an influx of legal challenges from multiple jurisdictions. “If I were in your shoes, there’s no way I’d approach the Court with this case,” she remarked, eliciting laughter from the courtroom, according to reports from Fox News.

When U.S. Solicitor General John Sauer attempted to present his defense, Kagan interjected, underscoring the gravity of the situation. “This is not a hypothetical – this is happening out there. Every court is ruling against you,” she stated, highlighting the widespread opposition the administration faces.

The legal battle stems from an executive order issued by the Trump administration in early 2025, which seeks to reinterpret the 14th Amendment. This reinterpretation aims to deny automatic U.S. citizenship to children born in the country to mothers who are in the U.S. illegally or temporarily, as well as fathers who are neither citizens nor lawful permanent residents. Courts in Maryland, Massachusetts, and Washington state quickly issued rulings against the order, labeling it unconstitutional. All three courts granted nationwide injunctions—a legal tool that the administration contends exceeds judicial authority. “The administration is losing uniformly,” Kagan noted, pointing to these unfavorable rulings.

While the Supreme Court is not yet directly addressing the constitutionality of Trump’s birthright citizenship policy at this stage, it is evaluating the validity of expansive injunctions that have national applicability. The outcome of this case could set a crucial precedent, especially considering that over 310 federal lawsuits have been initiated against Trump’s administration since he returned to the presidency in 2025. Many of these lawsuits have relied on nationwide injunctions to promptly challenge contentious policies.

As the Supreme Court prepares to issue its ruling—anticipated by June—it holds the potential to reshape the balance of power between the judiciary and the executive branches. The decision could redefine the legal landscape regarding presidential accountability and the defense of constitutional rights in court.
