Surprising Reversal: Trump Administration Astonishingly Reconsiders Mass Student Visa Revocation

In a significant policy reversal, the Trump administration announced plans to reinstate hundreds of international student visas that were recently revoked. The decision follows a series of lawsuits filed by international students enrolled at U.S. universities challenging the cancellations. On Friday, a Justice Department lawyer informed a federal judge in Washington that the U.S. Immigration and Customs Enforcement (ICE) agency would cease altering international students’ status based solely on checks against a national crime database. This announcement, provided in a statement to Bloomberg by a lawyer representing some of the affected students, confirms that ICE will reinstate visas previously revoked on this basis.

The administration’s revocation of these visas prompted more than 30 lawsuits from students, some of whom insisted they had no criminal history despite being flagged in the database. Politico was the first to report on the statement made in response to a Washington lawsuit, although this policy change is anticipated to impact all similar cases. Representatives from the Justice and Homeland Security departments have yet to comment on this development.

In a parallel legal challenge, a number of international students were detained by immigration authorities for participating in pro-Palestinian activities. The new policy’s impact on those cases remains uncertain, as many involved students have no criminal records. ICE continues to assert authority to revoke visas for other grounds, such as engaging in unlawful activities that could lead to deportation.

This policy reversal occurred shortly after a federal judge in Connecticut halted the deportation of numerous international students from Yale University and other institutions, marking another setback for President Donald Trump’s stringent immigration policies. U.S. District Judge Omar Williams issued an order preventing ICE from deporting these students or relocating them from Connecticut until it can be determined if their visas were rightfully terminated.

The legal intervention followed a lawsuit filed by four students from Yale and the University of Connecticut earlier that day. They sought class-action status for at least 53 students across the state who allegedly lost their visas without due notice or a hearing. The plaintiffs claimed the U.S. government’s actions put them at risk of immediate deportation, causing widespread distress and disrupting their academic pursuits, including research and preparations for final exams and graduation.

Meanwhile, U.S. Secretary of State Marco Rubio defended the visa revocations on foreign policy grounds, emphasizing the sovereign right of every nation to control its borders. Despite this stance, courts have consistently cautioned the administration against deporting non-citizens without due process.

In a separate case, the American Civil Liberties Union petitioned a federal judge in Washington to order the return of accused gang members deported to a notorious prison in El Salvador. The ACLU cited their lack of opportunity to contest these claims, drawing on a Supreme Court decision mandating the return of a Maryland man deported under similar circumstances. U.S. District Judge James Boasberg is considering holding Trump administration officials in contempt for defying his order to reverse deportations.

Recent court rulings have incrementally protected accused gang members from deportation without due notice and the opportunity to challenge allegations.
