Breaking: High Court Shields YouTuber Ashish Chanchlani From Arrest in Assam—A Triumph for Creative Freedom!
In a recent turn of events, the Gauhati High Court has granted interim anticipatory bail to YouTuber Ashish Chanchlani. This is in light of an FIR filed by the Guwahati Police, alleging that Chanchlani made obscene and controversial comments during an episode of “India’s Got Latent.” Justice Mridul Kumar Kalita, while providing this temporary relief, has instructed Chanchlani to present himself to the Investigating Officer within ten days. The final hearing is scheduled for March 7, where the court will also review the case diary.
The controversy emerged on the same day when the Supreme Court offered interim protection from arrest to another YouTuber, Ranveer Allahabadia, famously known as Beer Biceps. He faces FIRs for alleged obscenity over remarks made on the same show, with cases lodged in Mumbai, Guwahati, and Jaipur. Although Allahabadia received interim relief, he was sternly criticized by Justice Surya Kant for his “dirty” and “perverted” language.
The FIR in question was filed by Assam Police on February 12, invoking several sections related to the insult of women’s modesty, obscene acts, and childhood involvement in offenses, among others. This includes Sections 79, 95, 294, and 296 BNS, with ties to the IT Act 2000 and the Cinematograph Act 1952. The complaints suggest that Chanchlani, along with Jaspreet Singh, Apoorva Mukhija, and others, engaged in vulgar discussions on the show.
Chanchlani’s defense, led by Diganta Das and Joyraj Borah, argues his innocence, claiming that the alleged comments were actually made by guest panellist, Ranveer Allahabadia. They further assert that Chanchlani had no involvement in the editing or post-production of the episode and neither supported nor endorsed the remarks.
These proceedings not only highlight the ongoing legal battles faced by content creators but also bring attention to the fine line between creative expression and obscenity in digital media.
