Supreme Court Upholds Civil Court’s Authority in Property Disputes

In a significant ruling, the Supreme Court has established that civil courts have the authority to adjudicate disputes involving property rights, even when statutes allocate exclusive powers to revenue authorities for property partition. This decision arises from an appeal challenging the Gauhati High Court’s ruling concerning partition under the Assam Land and Revenue Regulation, 1886.

The case began when the appellant received a declaration of title and joint possession over a contested property, also gaining the freedom to pursue partition. A partition request was subsequently filed with the Additional Deputy Commissioner (Revenue Authority) but was denied due to the appellant’s lack of possession and the absence of consent from other co-owners.

When the civil suit for partition was initially dismissed, the First Appellate Court supported the appellant, allowing the revenue authorities to execute the partition. However, the respondent objected, leading to a second appeal contending that civil courts lacked jurisdiction in matters assigned exclusively to revenue authorities, as per Section 154(1)(e) of the Assam Land and Revenue Regulation.

Upon the case reaching the Supreme Court, the appellant argued that issues of possession and consent fall under the civil court’s jurisdiction. The Supreme Court agreed, emphasizing that although revenue authorities handle the partition process, civil courts possess the jurisdiction to determine entitlements related to title, possession, and shares in property. The Court highlighted that civil court jurisdiction remains unaffected unless there is a direct conflict with the Civil Procedure Code.

Overturning the High Court’s decision, the Supreme Court reasserted that civil courts can decide on the entitlement to partition, leaving the practical implementation to revenue authorities. This ruling clarifies the roles and boundaries of civil and revenue authorities in property disputes, ensuring clearer jurisdictional guidelines.
