Justice Denied: Court’s Bold Stand in Wadala GRP Custodial Death Case Spurs Hope for Accountability
A special court has denied a request to adjourn proceedings in the 2014 custodial death case of Agnelo Valdaris, a 25-year-old, allegedly killed by officials of the Wadala Government Railway Police (GRP). The adjournment was sought while awaiting the Bombay High Court’s decision on whether the accused should face murder charges. The court emphasized the prolonged nature of the case and found it unsustainable to delay further.
The case has been mired in legal complexities. Initially, Valdaris was reported to have died in police custody after attempting to escape and colliding with a train. However, witnesses, including a minor arrested alongside him, claimed they suffered physical and sexual abuse by the police and that Valdaris was in no condition to flee. While the CBI, tasked with the investigation, found no direct evidence of murder, it filed charges related to assault and violations of the Protection of Children from Sexual Offences Act.
In 2019, the Bombay High Court directed the trial court to press ahead with murder and evidence destruction charges against the eight accused, countering the CBI’s findings. In September 2022, the trial court ruled the police’s conduct suspicious enough to potentially warrant murder charges. However, two contrasting orders from the High Court added to the uncertainty: one dismissing a petition against the trial court’s directive in December 2022, and another in April 2023 dropping murder charges against the police.
The Supreme Court intervened in April 2024, directing the establishment of a larger bench to resolve the issue due to contradicting High Court orders. With no hearing yet scheduled in the High Court, this high-profile case remains in a state of legal limbo, open to further developments.
