Unleashing the Future: Overcoming Challenges of E-Filing in Maharashtra Courts – Pune’s Digital Revolution on the Horizon
In a bid to modernize, India’s judiciary has embarked on a digital revolution through an e-filing system intended to enhance accessibility and address backlogs. This initiative, now mandatory in Maharashtra’s lower courts since September 2023, is designed to improve speed and convenience during legal proceedings. However, its implementation has been disrupted by technical glitches and reliance on traditional physical files, according to Pune-based criminal defense lawyer Jitendra Sawant. Challenges such as server outages, court fee payment issues, and poor internet connectivity hinder the system’s effectiveness, highlighting a gap in training and technical support for court staff.
While the e-filing system holds promise for enhancing efficiency and reducing paper usage, advocate Sawant cautions that it may marginalize those less tech-savvy, especially senior practitioners accustomed to traditional methods. Under the E-Courts Mission Mode Project’s Phase 3, over 49 million cases were filed electronically by August 2024, with numerous e-Sewa Kendras established to facilitate tech access for those in remote areas. Advocate Parth Chanchlani highlights how this digital shift can empower marginalized individuals, such as rural farmers involved in land disputes, to access justice more affordably.
Despite these advancements, concerns around ethics, digital literacy, and cybersecurity remain prominent. Dr. Shaista Peerzada, from Ajeenkya D Y Patil University, advocates for collaborative approaches to address these challenges, ensuring the judiciary’s digital transformation is secure and equitable. Legal education is evolving in line with these changes, as institutions like ILS Law College in Pune integrate e-filing modules into their curriculum to prepare future professionals for an increasingly digital legal landscape.
