Supreme Court Seeks Procedure to Handle Cases of Foreign Nationals Jumping Bail
New Delhi, November 15 (IANS): The Supreme Court of India has directed the central government to establish a procedure to address situations where foreign nationals, accused of crimes in India, evade legal proceedings by jumping bail and fleeing the country. This directive emerged during the hearing of a Special Leave Petition filed by the state of Jharkhand against the bail granted to a Nigerian citizen.
The case, overseen by Justices Sudhanshu Dhulia and Ahsanuddin Amanullah, involved allegations that the accused, Alex David, also known as M.U. Henry, violated bail conditions and absconded from India. In light of these serious allegations, the apex court decided to involve the Union of India in the litigation, instructing the Solicitor General or his counsel to appear before the court.
Advocate Kanu Agrawal, representing the Centre, informed the court that the central government is actively working on the matter and will soon report its progress regarding the procedures to be implemented. The Supreme Court emphasized the recurring nature of such incidents and insisted on the necessity of a formal procedure to handle these situations.
The case is scheduled for further deliberation on November 26. The accused faces charges under several sections of the Indian Penal Code, including Sections 419, 420, 467, 468, 471, and 120B, as well as Section 66(D) of the Information Technology Act. These charges are linked to a 2019 FIR filed at P.S. Cyber in Jharkhand.
In May 2022, the Jharkhand High Court granted bail to Alex David, considering that he had been in custody since January 2020. Although authorities recovered multiple mobile phones and SIM cards allegedly used in cybercrimes, the court allowed his release on a bail bond of Rs 10,000, backed by two similar sureties.
This case brings to the forefront the need for a systematic approach to prevent foreign nationals from evading justice in India.
