Explosive Development: NIA Court Charges Akhil Gogoi Under UAPA for Defiant Anti-CAA Protests
In Guwahati, Assam MLA Akhil Gogoi and three of his associates, Dhaijya Konwar, Bittu Sonowal, and Manash Konwar, have been charged under the Unlawful Activities Prevention Act (UAPA) and several sections of the Indian Penal Code (IPC) due to their alleged involvement in the anti-Citizenship Amendment Act (CAA) protests. A special National Investigation Agency (NIA) court has framed charges against Gogoi under UAPA Section 18, which pertains to conspiracy, as well as IPC sections 120B, 153A, and 153B, which include criminal conspiracy and promoting enmity.
The court, however, dismissed the proposed charges under UAPA Section 39, related to providing support to terrorist organizations, and IPC Section 124A, which involves sedition. Gogoi, expressing dissatisfaction, described the charges as politically motivated, suggesting they were intended to keep him imprisoned. He announced plans to appeal the charges in the Gauhati High Court.
The NIA had been investigating two cases against Gogoi and his associates concerning their purported role in the anti-CAA protests that turned violent in December 2019. The legal proceedings have drawn attention due to the stringent nature of the UAPA and the political implications surrounding the anti-CAA movements in Assam.
This development reflects ongoing tensions and the complex legal battles stemming from the contentious CAA, highlighting the intersection of politics and law in addressing dissent in the region.
