Tripura High Court Enforces 2014 Noise Limiter Order for Puja Festivities

Agartala, 25th September 2024: The Tripura High Court’s Division Bench, headed by Chief Justice AK Singh and Justice Arindam Lodh, has mandated the strict enforcement of its 2014 judgment on sound limiters in music systems, announced Advocate General of Tripura, Siddharth Sankar Dey. The directive emerged from a Public Interest Litigation (PIL) filed by Anal Roy Chowdhury, editor of the vernacular daily Pratibadi Kalam, concerning noise pollution from loudspeakers and sound systems during Puja celebrations.
Advocate General Dey explained that the PIL’s central aim is to ensure Durga Puja festivities are not marred by disruptive noise pollution. The 2014 High Court order capped noise levels at 65 decibels for all loud music equipment and mandated the installation of sound limiters. Equipment without limiters cannot be sold, rented, or used, Dey reiterated.
In its latest directive, the High Court ordered the state administration to seize all high-noise-producing sound systems lacking limiters. The court warned of stringent consequences for non-compliance by the authorities.
Advocate Subrata Sarkar, representing the petitioner, underscored the 2014 ruling which allowed a relaxation of noise limits for only 15 specific days annually, extending permissible hours from 10 pm to midnight. Outside these days, loud music is banned between 10 pm and 6 am. The bench emphasized strict adherence to this prior order.
Assisted by Ayesha S Hirawat and K.D. Singha, Advocate Subrata Sarkar presented the case, stressing the importance of minimizing health risks associated with noise pollution.
Advocate General Dey assured the court that he would promptly notify the relevant authorities and ensure compliance with the High Court’s directive.
