Victims File FIR Against Assam Police Officers Over Alleged Fake Encounter
In a disturbing development from Tinsukia district, Assam, three individuals have filed a First Information Report (FIR) against four police officers and at least ten other police personnel, alleging a staged encounter. The victims, Dipjyoti Neog, Manuj Buragohain, and Biswanath Borgohain, have accused former Sadiya police district Superintendent of Police (SP) Mrinal Deka and three other officers of orchestrating the encounter.
The FIR was lodged at Dholla Police Station on Thursday, naming Sub-Inspector (UB) Debasis Dekari, Inspector Sim-Singh Timung, and former Tinsukia Assistant Superintendent of Police (ASP) Bibhash Das, along with Deka, who is currently the Deputy Commissioner of Police (East) in Guwahati.
According to the FIR, the alleged incident took place on December 23, 2023. The victims claim they were apprehended by Assam Rifles that night and subsequently handed over to a police team led by SP Deka. They further alleged that after consuming alcohol with the Assam Rifles officials, SP Deka and his team took them into the Hahkhati forest reserve. In a harrowing account, the victims stated that around 3 am on December 24, the police made them lie down and shot them in their legs.
This FIR comes a day after all three victims filed an affidavit with the Supreme Court, detailing the sequence of events and claiming links with the United Liberation Front of Assam-Independent (ULFA-I).
The Supreme Court has taken note of the allegations. On September 10, the court heard a Special Leave Petition (SLP) against a Gauhati High Court order which dismissed a Public Interest Litigation (PIL) on similar alleged fake encounters by Assam police. Justice Surya Kant suggested forming a commission to probe the matter, while Justice Ujjal Bhuyan emphasized that such actions undermine the rule of law.
The petitioner, advocate Arif Md Yeasin Jwadder, alleged that over 80 fake encounters have occurred in Assam since May 2021, when Chief Minister Himanta Biswa Sarma took office. The petitioner seeks an independent inquiry by agencies like the Central Bureau of Investigation (CBI) or a Special Investigation Team (SIT).
