Meghalaya Minister Reaffirms Commitment to Tribal Land Rights
Shillong: The Meghalaya government remains steadfast in protecting tribal land rights, as affirmed by Kyrmen Shylla, the state’s Minister for Revenue and Disaster Management. Shylla addressed the issue during a discussion in the Meghalaya assembly, emphasizing that all land transfers adhere to the Meghalaya Transfer of Land Regulation Act, 1971, and its 1974 rules.
Responding to concerns from opposition legislator Adelbert Nongrum, Shylla stressed that the government diligently follows the Act to safeguard tribal interests. "Our commitment is unwavering," he affirmed, noting that each land transfer must go through the Revenue and Disaster Management Department to ensure compliance with the law.
Key provisions of the Act, particularly Section 3, are crucial in preventing unauthorized land transfers. This section prohibits land transfers from tribals to non-tribals or between non-tribals without the competent authority’s prior permission. Strengthened in 1973, the Act allows the government to impose restrictions on land transfers in specified areas. Moreover, a 1991 amendment introduced exemptions for certain land transfers under specific conditions outlined in Section 4.
Shylla underscored that the primary goal of the Meghalaya Transfer of Land Regulation Act is to protect the state’s Scheduled Tribes by tightly regulating land transactions. The government employs a rigorous procedure to ensure adherence to these regulations.
The land transfer process involves several steps: the buyer submits an application to the Deputy Commissioner with all necessary details; the application is verified for legitimacy; recommendations are made to the Revenue and Disaster Management Department; and final approval is granted if the proposal meets the Act’s criteria.
