Nagaland Legislative Assembly to Pass Road Safety Amendment Bill
Our Correspondent, Kohima | August 28: The Nagaland Legislative Assembly (NLA) will pass the Nagaland Road Safety Authority (Second Amendment) Bill, 2024, on August 29. The bill was introduced by Deputy Chief Minister T R Zeliang on August 27 during the 5th session of the 14th NLA. NLA Speaker Sharingain Longkumer confirmed the bill’s scheduled consideration and passage on August 29.
Chief Minister Neiphiu Rio highlighted that the original Nagaland Road Safety Authority Act was enacted in 2013 to advise the State Government on road safety policies, enforce standards, formulate programs, and establish a Road Safety Fund. The Authority operates under the Motor Vehicles Act, 1988, and follows directives from the Supreme Court Committee on Road Safety as well as advisories from the Central Government.
The Ministry of Road Transport & Highways (MoRTH) issued revised guidelines under Section 215(3) of the Motor Vehicles (Amendment) Act, 2019, aiming to standardize the structure, composition, and functions of District Road Safety Committees across the country. Additionally, there have been complaints from transport operators and vehicle owners regarding the road safety cess, leading to a proposal to amend the Nagaland Road Safety Act, 2013, to incorporate these new guidelines and rationalize the cess.
The Memorandum of Delegated Legislation refers to Section 215 of the Motor Vehicles Act, 1988, which empowers state governments to constitute District Road Safety Committees. Sub-section (b) of Section 215A allows state governments to delegate powers and functions to public servants or authorities under the Act. Section 10 of the 2013 Nagaland Road Safety Authority Act also provides for the levy of cess.
The impending amendment seeks to align state regulations with national standards and address stakeholder concerns, thereby enhancing road safety measures in Nagaland.
