Bombay High Court Halts Indrani Mukerjea’s Travel to Spain and UK

Mumbai: On Tuesday, the Bombay High Court issued an ad interim stay on a special court order permitting Indrani Mukerjea to travel to Spain and the United Kingdom until July 29. Indrani Mukerjea, the main accused in the alleged murder of her daughter, Sheena Bora, is currently out on bail. Justice Sarang V. Kotwal, a single Bench judge, stayed the special court’s July 19 decision that allowed her to travel abroad, stating that the matter warrants a detailed hearing set for July 29.

Advocate Ranjeet Sangle, representing Mukerjea, argued that his client cannot travel as she lacks possession of her passport. However, Mukerjea needs to update bank documents at Banco Sabadell in Spain, settle local bills, and manage her legal documents, including her Will and assets. Her plea indicated an intention to remove her ex-husband Peter Mukerjea from her Will’s beneficiaries. Sangle also noted she is a British citizen, making her travel routine.

The CBI’s Special Public Prosecutor, Shriram Shirsath, opposed the plea, arguing that Mukerjea, being the prime accused in an ongoing case, should not be permitted to travel internationally at this stage. The special CBI court had originally allowed a 10-day travel period within the next three months, subject to specific conditions. These included a ₹2 lakh cash security deposit and a requirement for Mukerjea to report to the Indian Embassy in Spain and the UK. The CBI’s flight risk concerns were addressed by noting India’s extradition treaties with these countries.

Moreover, the court mandated Mukerjea to submit her immovable and movable property details to the CBI. Any attempt to seek an extension of her stay abroad would result in the forfeiture of her security deposit and the issuance of a non-bailable warrant.

The High Court’s stay reflects caution in considering the gravity of the charges Mukerjea faces, emphasizing the necessity for adherence to judicial scrutiny before any international travel.
