Colombian pop star Shakira has won a long-running legal battle with Spain’s tax authorities after the country’s National High Court annulled a 2011 tax ruling and declared a €55 million fine-reported in the source as roughly 710 crore taka-illegal, ordering the money returned with interest. The court said Spain’s tax agency failed to prove that Shakira met the minimum conditions to be a Spanish tax resident in 2011, and therefore could not sustain the punitive assessment against her.
At issue was the 183-day rule used to determine tax residency: Spanish authorities argued Shakira spent more than 183 days in Spain in 2011 and was therefore liable for taxes there. The court, however, found the tax agency could not substantiate that claim or show that she had financial interests or family ties in Spain at the time-key factors in establishing residency under Spanish law.
Shakira’s legal team had long maintained that spending more than half the year in Spain in 2011 was impossible given her global touring schedule. They pointed to a 2011 itinerary that included roughly 120 performances across 37 countries and stressed that she did not own a home in Spain then, had no children yet, and had no Spanish business headquarters. (Shakira’s two children with former Barcelona footballer Gerard Piqué were born in 2013 and 2015; the couple announced their separation in 2022.)
The court’s decision requires the tax agency to return the €55 million plus accrued interest, but the agency has said it will appeal to Spain’s highest court. Officials also stated that this ruling does not affect a previous agreement covering the 2012–2014 tax years: in November 2023 Shakira accepted six counts related to those years and agreed to pay €7.3 million to avoid prison, a settlement she said at the time was intended to protect her children and focus on her career.
Shakira’s legal team hailed the 2011 decision as a definitive victory. Speaking after the ruling, the singer-who had publicly criticised the tax case as a deliberate campaign that damaged her reputation-appeared emotional, saying that after more than eight years of public anger and reputational harm, the court has finally brought the truth to light. The ruling closes a major chapter in a high-profile dispute over tax residency, evidence standards and how countries apply residency rules to globally mobile celebrities.
