Madras HC Grants Hope: Authorities Ordered to Issue Passport to Son of Sri Lankan Tamil Refugees

In a landmark ruling, the Madurai Bench of the Madras High Court has affirmed that Gokuleswaran, a man born to Sri Lankan Tamil parents in Tiruchi in 1986, is an Indian citizen entitled to an Indian passport. This decision comes as a significant relief as it upholds the Citizenship Act, 1955, which provides citizenship rights based on birthplace.

Gokuleswaran was born on February 9, 1986, in a government hospital in Tiruchi. His parents, fleeing civil conflict in Sri Lanka, settled in the Sri Lankan Tamils Rehabilitation Camp in Kottapattu, Tiruchi, in 1983. According to Section 3 of the Citizenship Act, 1955, anyone born in India between January 25, 1950, and July 1, 1987, is considered a citizen, regardless of their parents’ nationality. Gokuleswaran argued that, being born in India, he qualified for citizenship by birth.

In 2024, he applied for an Indian passport but faced delays when the Regional Passport Officer in Tiruchi issued an objection letter. The letter cited an adverse police report received from the Commissioner of Police, indicating concerns regarding Gokuleswaran’s citizenship status due to his parents’ nationality. In response, Gokuleswaran presented original documents, including his birth certificate, along with copies of judicial orders affirming his citizenship. Despite these efforts, he received further requests for clarification, leading to a prolonged struggle to secure his passport.

Justice P.T. Asha emphasized during proceedings that the authenticity of Gokuleswaran’s birth certificate had been confirmed by the relevant authorities. His date of birth was consistently reflected on his SSLC and HSC mark sheets, reinforcing his claim to Indian citizenship. The court noted that under the Citizenship Act, his birth on February 9, 1986, firmly establishes his status as an Indian citizen.

The judgment underlines that once citizenship by birth is verified, any negative reports concerning a person’s parental nationality can’t negate statutory rights. Consequently, the court directed the Regional Passport Officer to process Gokuleswaran’s application without further delay.

This ruling not only emphasizes the importance of citizenship rights in India but also highlights the ongoing challenges faced by individuals of refugee backgrounds when navigating bureaucratic hurdles. For Gokuleswaran, this decision marks a significant step towards rectifying his status and obtaining the identification crucial for his future.
