The creators of the AI company Anthropic have agreed to pay at least $1.5 billion to resolve a copyright infringement lawsuit filed by authors. The lawsuit claims that the company illegally used pirated copies of books to train its large language models. Under the settlement, Anthropic will pay approximately $3,000 for each of the estimated 500,000 books involved, although the total amount could increase based on the number of legitimate claims. The company will also need to destroy the original downloaded files and any copies, marking a significant victory for authors facing challenges in the AI era.
The lawsuit began last year when three authors-Andrea Bartz, Charles Graber, and Kark Wallace-filed a case against Anthropic. They represent a large group of authors and publishers whose works were allegedly downloaded via pirated websites to train the chatbots. In June, a federal judge in the U.S. ruled that using copyrighted books for AI training is not illegal, though acquiring them through piracy is inappropriate. In July, a federal judge in California authorized a class-action lawsuit on behalf of affected authors against these pirated libraries.
Next week, the settlement awaits approval and could set a precedent for fair use in generative AI systems. Fair use policies allow limited use of copyrighted materials without permission, such as quoting in news articles. Mary Rachenberg, CEO of the Authors Guild, stated in a release that the settlement marks an important step in acknowledging that AI companies cannot simply steal a writer’s creative work. She added that this should lead to more licensing agreements, providing authors with compensation and control over their work in a free market society.
