SpiceJet Urgently Appeals Delhi HC’s Grounding Directive: Critical Plea for Justice
SpiceJet Seeks Urgent Delhi High Court Intervention to Prevent Engine Grounding
New Delhi, August 16 (IANS): Low-cost carrier SpiceJet urgently requested a hearing from the Delhi High Court on Friday, as it contests an order mandating the airline to ground three engines by February 16. This emergency plea was presented before Acting Chief Justice (ACJ) Manmohan, who deferred the hearing to Tuesday due to many judges being on leave.
The urgency comes in response to a directive issued by a single-judge Bench led by Justice Manmeet Singh Arora, which instructs the debt-ridden airline to return three engines to their lessors within 15 days. Justice Arora’s order highlighted that SpiceJet is a defaulter with no legal or contractual rights to continue using the engines. The court remarked that allowing SpiceJet to operate the engines without settling overdue payments would exacerbate the financial distress of the lessors.
The ruling underscores SpiceJet’s significant financial troubles, noting the airline’s acknowledged inability to pay outstanding dues. The lessors emphasized the detrimental financial impact of letting SpiceJet retain the engines without compensating them.
Previously, the Delhi High Court granted SpiceJet permission to keep using the engines after the airline committed on May 29 to repay outstanding lease amounts along with additional weekly payments. Nevertheless, the return of the engines does not absolve SpiceJet of its obligation to settle the admitted overdue payments.
The ongoing financial predicament raises concerns about SpiceJet’s operational stability and its ability to manage lease agreements and financial responsibilities. This development adds pressure on the airline to secure its financial footing and address its liabilities promptly.
This case is particularly significant for stakeholders and investors monitoring SpiceJet’s financial health and operational capabilities in the high-stakes aviation sector.
This summary utilizes a professional and journalistic tone to clearly present SpiceJet’s legal and financial challenges in a concise and engaging manner suitable for a business audience.
