
Supreme Court Dismisses Woman’s $12 Million Claim After 18-Month Marriage
In a notable ruling, the Supreme Court addressed a prolonged divorce case that has been ongoing for eight years since a marriage lasting only 18 months. The court labeled the woman’s claims for 1.2 billion rupees, a BMW, and a flat in Mumbai as “unethical and unreasonable.” The verdict was delivered by a bench led by Chief Justice B.R. Gavai, alongside Justices K. Vinod Chandran and N.V. Anjaria, who granted the divorce while instructing that a flat in Mumbai must be allocated to the woman as part of her maintenance provisions.
Reports indicate that the couple’s marriage was short-lived, lasting less than 18 months, after which legal disputes ensued between them. In 2022, the woman had initially signed a settlement agreement, requesting only a flat with two parking spaces in Mumbai, without making any claims for maintenance at that time. However, she later reneged on this settlement, filing a new claim in the Bombay High Court for a substantial sum, along with the BMW and other valuable property, which prompted her husband to contest these demands before the Supreme Court.
The court remarked, “You are a highly educated individual working in the IT sector. You should not beg; earn your own livelihood. Your marriage lasted only 18 months. Now, you are claiming 1 crore rupees per month and a BMW?” The justices emphasized that the woman is capable of supporting herself, noting a significant decline in the husband’s financial standing compared to earlier years. Previously, the husband earned around 25 million rupees annually at a private bank, but his current income has plummeted to only 1.8 million rupees a year.
While approving the divorce, the bench ordered that a flat must be provided to the woman in Mumbai but rejected her claims for the 1.2 billion rupees, the BMW, and other assets. This judgment sets a new perspective on spousal maintenance claims in divorce matters, delivering a firm warning against unreasonable demands from financially independent and educated women.
